1. Our contract
All bookings are made with EMPIRIC GROUP, international trade and travelling Inc.. By booking a tour with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us), and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.
Dates, itineraries, and prices are valid from 5 March 2015 until 31 December 2015. Beyond 31 December 2015, dates, itineraries and prices are indicative only.
3. Deposit requirement
You are required to pay 35% of the itinerary price per person per trip for your booking to be confirmed. If your booking is made within 60 days of the departure date for tours then the full amount 100% is payable at the time of booking.
4. Acceptance of booking and final payments
If we accept your booking, we will issue an Order confirmation. A contract will exist between us from the date we issue the Order confirmation and we accept your 35% deposit or 100% payment. Please refer to your booking confirmation invoice for details regarding final payments.
Payment of the balance of the trip price is due 60 days for tours before the departure date. If this balance is not paid on or before the due date, we reserve the right to treat your booking as canceled.
Your booking is binding. You can only with canceled it in accordance with the provisions about the cancellation of the trip by the traveler. A binding booking is also each order submitted in writing which contains your and your party’s name and surname, address, nationality, gender, passport number, credit card number or the identification of another payment instrument, full or partial payment of the booking.
A contract is deemed concluded on the day of Order confirmation issue by us.
Promptly and correctly paid booking and costs of booking guarantee your participation or a free spot in an individual travel arrangement or tour under these general terms and conditions, and instructions for travel arrangements, or under special terms and conditions or the itinerary.
Upon departure, you must submit to the agent in charge of the tour the Voucher. Otherwise, the agent in charge of the tour will not accept you to go on the tour or arrangement.
You may pay with a direct transfer to our bank account, or via Paymill at www.spiritual-bali-tour.com. In the case of a refund, we cannot pay in cash. Instead, you may request a credit note if you are entitled to one or all monies you paid are returned to your bank account.
The information you obtain by phone or e-mail, or at the booking spot does not bind us any more than indications in the itinerary or offer. If in doubt, the following is always deemed valid: written offer, written information or written explanation.
5. Your details
In order for us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have that may affect your ability to complete your travel arrangements. If you are 70 years of age or over, we also require you to complete and forward a Self-Assessment form. Your booking cannot be confirmed without provision of these details.
If correct information is not stated upon booking, you are responsible for all the costs or consequences incurred by false information.
6. Cancellation by the traveler for tours
If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:
• between 75 and 60 days prior to departure, we will retain the 15% of the total tour price
• between 59 and 50 days prior to departure, we will retain the 30% of the total tour price
• between 49 and 41 days prior to departure, we will retain the 45% of the total tour price
• between 40 and 31 days prior to departure, we will retain the 65% of the total tour price
• less than 30 days prior to departure or if you don’t show up on the day of departure or cancel the arrangement after it has already begun, we will retain 100% of the total tour price
In the arrangement or parts of arrangements where the refund of our partners’ costs (other agencies, airlines) does not match the aforementioned refund of costs by us, the refund of costs of the business partner carrying out the arrangement or part of the arrangement applies.
Please ask for full details of cancellation charges at the time of booking. You are strongly advised to take out cancellation insurance at the time of booking that will cover cancellation fees.
If you leave a tour for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents or third party tour and transport operator fees.
7. Cancellation by EMPIRIC GROUP, international trade and travelling Inc.
Pursuant to the applicable legislation, we reserve the right to cancel a tour. We may cancel a tour at any time up to 35 days before departure if the required number of travelers stated in the itinerary is not reached (subject to clause 14). The minimum number of travelers is 10 unless otherwise stated in the itinerary.
We may cancel a tour at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary.
We may terminate the contract or withdraw from the contract, and request the reimbursement of damage from travellers who directly breach the provisions of the contract concluded with us, especially if it is established that the traveller has intentionally submitted false information about the number of travellers or their age, or if changes occurred during the trip and the traveller failed to notify the agency.
We reserve the right to fully or partially withdraw from the contract if, prior to, or during, the implementation of the itinerary, extraordinary circumstances arise which could not be expected, removed or avoided and which would be a justified reason for us not to conclude the contract if they existed at the time of the conclusion. Regarding travel arrangements and other services where the nice or suitable weather is a crucial condition for the itinerary to be carried out, a withdrawal from the contract due to bad or unsuitable weather is deemed a withdrawal from the contract due to extraordinary circumstances. In this case, you have the right to a refund of all monies paid or to transfer all monies paid to another date.
We reserve the right to change the date and time of departure or to cancel the trip due to changes in flight schedule or force majeure, and the right to change the course of the trip if the conditions of the trip change (new schedule, insecure situation in the country where the itinerary is to be carried out, natural disasters or other unforeseeable circumstances beyond our control), without any compensation and according to the regulations applicable to passenger transport.
We do not accept responsibility for changes in the itinerary due to force majeure during the implementation of the itinerary. In such cases, we may provide other services to you, depending on existing options.
If we cancel your trip, you can transfer amounts paid to an alternate departure date or alternatively receive a refund. The costs of the reservation in the amount of € 200 are retained. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
We immediately notify you of any subsequent changes in the itinerary.
We are not responsible for any delays of flights, ships or trains, or for any changes in the itinerary which are the consequence of such delays.
If the situation at the destination does not allow us to accommodate you in the ordered facility, we may accommodate you in another facility of the same category in the same place.
8. Booking amendments
If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 60 days prior to the proposed departure date for tours and 120 days prior to the proposed departure date for tours including ayurvedic treatments. A fee of €150 per person per change will apply (in addition to any charges levied by hotels or ground operators).
No amendments are permitted to your booking within 60 days of departure for tours.
The land price of your trip includes:
• all accommodation
• all transport included airport transfers
• sightseeing and meals
• the services of a group leader

The land price of your trip does not include:
• international or internal flights unless specified
• taxes and excess baggage charges unless specified
• meals other than those specified as listed in Price includes on our website: www.spiritual-bali-tour.com
• Visa and passport fees
• travel insurance
• Optional activities and all personal expenses
11. Request about your arrangement your flight
On your arrival at the airport, a driver will be waiting for you at the meeting point, holding a spiritual tourist agency “EMPIRIC GROUP, international trade and travelling Inc.” sign. If at all possible, please arrange your flights in such a way that arrival is no later than 17.00 and your departure no earlier than 9.00.
After booking your flight, please inform us about arriving and departure (flight number and hour) not later than 3 weeks before the start of the tour.
We organized your transfer from airport to the hotel and back.
Please don’t book your flight before we confirm that the tour will be held when the minimum number of people is required.
We will confirm you the tour one day after the final deadline for booking and paying a tour.
12. Prices & surcharges
We notify you of any changes in the price of the itinerary. We reserve the right to impose surcharges up to 20 days before departure due to unfavourable changes in exchange rates, increases in transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances, you will be responsible for the balance. If the price grows by more than 10%, you have the right to cancel the trip. The costs of the reservation in the amount of € 250 are retained.
13. Age & Health requirements
All travellers under the age of 18 must be accompanied by a legal guardian, or, in lieu of a legal guardian, by an escort over the age of 18, appointed by their legal guardian. The legal guardian or their designee will be responsible for the traveller under the age of 18’s day-to-day care. If a legal guardian elects to designate an escort in their lieu, they will be required to complete and sign a relevant document to delegate their authority.
Please note we cannot guarantee triple or joining rooms for families; accompanying adults may be required to share with others in the group on a twin share basis. We will do our best.
Maximum General Policy: For the majority of our trips we have no upper age limit, though we remind you that our trips can be physically demanding and a Self-Assessment Form is required for all passengers 70 years and over.
It is your responsibility to ensure that you obtain proper and detailed medical advice at least two months prior to travel for the latest health requirements, recommendations for your destination and any costs.
Where you do not do so and either are not allowed to enter any country or suffer personal injury or death as a result, we have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements.
If any vaccinations are stated in, or required by, the itinerary of the trip, you must acquire an international certificate – a yellow booklet which contains entries of vaccinations carried out. We are not responsible for any potential complications or curtailment of the trip due to your failure to observe the healthcare regulations of the country of destination, or the itinerary that you booked, or for the costs related to the aforementioned.
14. Small groups & combination trips
Our trips are guaranteed to depart once they have one fully paid traveller unless the minimum group size specifically is specifically stated otherwise. This means at times we can have small groups. Many of our trips are designed to fit with other departures to create a longer “combination” trip; this means that some of your group may have already been travelling together for some weeks when you commence your trip. If you would like to know how many people are booked on your trip or any combination trip it is part of, please ask prior to making your booking.
15. Passport, documents and visas
You must carry a valid passport and must have obtained all of the appropriate visas, permits and certificates for the countries in which you will visit during your trip. Your passport must be valid for one year beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip. If the condition of individual countries for entering the country is that on the day of the entry, a travel document is valid for a certain period of time prior to its expiry, you must pay attention to such provisions, and we are not responsible for any problems or forceful curtailment of the trip arising from this fact.
We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.
Prior to the trip or the deadline stated in the itinerary as a departure, you must obtain visas for the countries of destination and undergo vaccinations required by these countries. If you do not fulfill this obligation, we act in accordance with the provisions about the cancellation of the trip by the traveler.
If you lose your documents or your documents are stolen from you during the trip, and they are necessary for you to continue the trip or return to your homeland, you must acquire new documents at your own expense.
If you have to curtail the trip due to the loss or theft of your documents, you are not eligible for any refunds of any monies paid for the trip or any costs.
16. Travel insurance
Travel insurance is compulsory for all EMPIRIC GROUP, international trade and travelling Inc. travellers and should be taken out at the time of booking. Please provide yourself the appropriated insurance. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation.e also strongly recommend that it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your tour; you will not be able to join the tour without it.
If you anticipate upon booking that you will perhaps not be able to go on the trip due to certain circumstances (involving you or your immediate family), we recommend you to decide on cancellation insurance.
The agreement on cancellation fee is applicable in the case of illness or death in your immediate family (spouse, parents, children) and may be enforced only upon the submission of a suitable certificate.
The cancellation fee is € 250. The itinerary may state a different amount of a cancellation fee or that a cancellation fee is not possible.
If you do not begin the tour on the day stated as the beginning of the trip and do not cancel the trip prior to its beginning, you do not have the right to enforce the refund of the monies paid on the basis of the cancellation fee paid. It is also considered that you did not begin the trip or that you withdrew from the contract when you are not received by the carrier (airline, ship, bus and similar) for any reason of safety or regulative nature, regardless of whether the event occurred during the trip or at the beginning of the trip. In such a case, you are responsible for all the damage incurred and you cannot enforce any refunds on the basis of the cancellation fee paid.
If you cancel the tour or withdraw from the contract due to documented unforeseeable or unavoidable force majeure prior to the conclusion of the contract for the trip, and you have suitable official documents about this, but you did not send in writing and submit any cancellation fee, we have the right to the refund of all our expenses already incurred and of all our expenses arising from the cancellation of the trip.
The excess is returned to you. A cancellation fee cannot be claimed after the trip or the holiday has begun or for the duration of the unutilised part of the trip or the holiday.
You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives. The itinerary provided for each trip is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport may be subject to alteration without prior notice due to local circumstances or events.
18. Change of itinerary
While we endeavor to operate all trips as described, we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.
Before departure: If we make a major change, we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change or accepting an alternative tour offered if there is some.
After departure: We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances, the additional cost of any necessary itinerary alterations will be covered by you on the spot.
Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itineraries such as visas, vaccinations or non-refundable flights.
19. Authority on tour
Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any person participating in the trip. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund.
We may also elect not to carry you on any future trips booked. At all times, you must comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
20. Punctuality of carriers
We are not responsible for the punctuality of land, sea and air transport when the latter is carried out by public means of transport in scheduled or exceptional passenger land, sea or air transport. The responsibility of carriers is suitably determined in the contract between you and the carrier which enters into force upon the use of the means of transport. Our responsibility is limited only to failure to organise a certain part of the itinerary which signifies certain material costs. We are not responsible for the non-material damage arising from delays, cancellations or changes in transport or means of transport.
21. Acceptance of risk
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate.
However it is also your own responsibility to acquaint yourself with all possible relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
22. Limitation of liability
a. We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent that it is obliged under the applicable laws. Our obligations, and those of our suppliers providing any service or facility included in your holiday are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause c. below.
b. In other circumstances, we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause c. below.
c. We shall not be liable for any damage or loss if the failure to carry out the contract is:
• attributable to you.
• attributable to a third party unconnected with the provision of the services contracted for and any event is unforeseeable or unavoidable.
• due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.
• due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
• due to an event which the company, even with all due care, could not foresee or forestall.
d. Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to three times the price paid. In the case of damaged property, the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases, the company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.
e. Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation, the compensation is limited by the following international conventions: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions.
f. Our acceptance of liability in clauses a and b above is subject to assignment by you of your rights against any agent, supplier or sub-contractor that is in any way responsible for the unsatisfactory arrangements or your death or personal injury.
Flights are not included in the trip price do not form part of the journey or this contract. You accept that no responsibility for flights is taken by our EMPIRIC GROUP, international trade and travelling Inc. spiritual traveling agency. We do not arrange optional flights for our tours.
The organiser, agent or broker is not responsible for the transport of baggage, for destroyed or lost baggage, or for the theft of baggage or other valuables at the hotel. As a traveller, you report lost or damage baggage to the carrier or the hotel. For the transport of special baggage, for example a, bicycle, a surfboard, golf equipment, etc., you pay surcharge to the carrier usually upon departure at the airport. In any case, you must report such baggage upon booking. However, due to the limited capacity, airlines reserve the right to refuse the transport of such baggage. You bear all the costs or damage incurred by such an event.
We are not responsible for the theft of, or damage to, your baggage or other personal belongings, valuables and documents at accommodation facilities (hotel rooms, apartments, etc.) and means of transport (planes, passenger vans, buses, ships, etc.).
25. Categories of accommodation facilities and house rules in general
The categories of accommodation facilities (number of stars or category of facilities) stated in our catalogs or itineraries for travel arrangements and trips are local or national categories, not our categories, and may vary depending on the country.
We inform you of international rules in accordance with which accommodation is usually possible after 2 pm on the day of arrival; on the day of departure, the room must be empty by 11am, unless otherwise stated in the itinerary. We are not responsible for any house rules or changes in house rules. You must always act in accordance with house rules.
26. Optional activities
We may state in the itinerary for you to pay all services provided on the spot. If you pay us to provide additional activities, we act as an organizer; if you pay for additional activities on the spot, we do not act as an organizer or a broker, but merely as an information provider. In this case, you enforce any complaints from the service provider on the spot.
Optional activities not included in the tour price do not form part of the tour or this contract. You accept that any assistance given by your tour leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.
27. Claims & complaints
If you have a complaint about your trip, please inform your tour leader or our local representative at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to us within 30 days of the end of the tour.
You should report any irregularities or shortcomings on the spot to our agent, representative or the authorized local agency. If, according to its content, a complaint may be resolved on the spot (for example untidy room, equipment, the position of the room, etc.), but you did not report the flaw on the spot and notify the aforementioned persons, it is considered that you agreed with the service provided and thus lost the right to file a subsequent complaint with a request for reduced payment of the service or the reimbursement of damage.
A complaint may be filed in writing within two months of your return. Without a written complaint, we will not address any claims for reduced payment, or compensation and other claims. A written complaint may be sent to the following address: Empiric Group Inc., international trade and travelling Inc., Britof 151a, 4000 Kranj. Slovenia, EU. A complaint must be signed, and filed b you on your own behalf or by a third party with your written authorization. The authorization must be attached to the complaint; otherwise, we will not address the complaint.
A complaint must be justified. Therefore, attach to the complaint all suitable evidence and/or certificate from an hotelier, carrier or any other suitable person of the actual situation based on which you are filing your complaint.
The amount of a complaint is limited by the amount of the arrangement paid. If the fault for the failure to implement the itinerary or provide certain services lies with our agency, you have the right to a complaint in the amount of the real value of services that were not provided. This provision does not apply if we have the right to cancel the arrangement or change the itinerary in accordance with the provisions of these general terms and conditions, and the law.
In the event that any term or condition contained in these Booking Conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
29. Photos and marketing
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.
The photos published on our website www.spiritual-bali-tour.com and promotional materials are for information purposes only, and the agency EMPIRIC GROUP, international trade and travelling Inc. does not guarantee the entirety or authenticity of their content and appearance when such a guarantee is not explicitly stated.
The images are only illustrative and it’s not necessary that they are a part of the tour you have chosen.
Any personal information that we collect about you may be used for any purpose associated with the operation of a tour or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the tour. If you do not wish to receive marketing material, you may subsequently cancel its reception.
All the acquired information about travellers is protected pursuant to the Personal Data Protection Act.
31. Financial protection
The Package Travel, Package Holidays and Package Tours Regulations of 1992 require us EMPIRIC GROUP, international trade and travelling Inc. to provide you security by Guarantee letter Number: 1/10013364061, for the monies that you pay for the package tours booked from us and for your repatriation in the event of our insolvency. We will provide you with financial protection for any Empiric Group, International Trade and Travelling, Inc. inclusive tour that you buy from us by way of our Organiser’s Licence number 1660, administered by the GTZ Slovenia (EU).
32. Applicable law
The laws of Slovenia govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Slovenia.

34. Updating of terms and conditions
The Company reserves the right to update and/or alter these terms and conditions at any time, and it is the Client’s responsibility to be familiar with them. The latest terms and conditions can always be found on the Company website (www.spiritual-bali-tour.com) and will supercede any previous versions.
